1. Introduction and Acceptance

Welcome to GuestSelects (the "Platform," "Website," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of the GuestSelects website and all associated services.

By accessing or using the Platform, you ("User," "you," or "your") acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must immediately discontinue use of the Platform.

We reserve the right to modify these Terms at any time. Continued use of the Platform following any such modifications constitutes your acceptance of the revised Terms.

2. Description of Service

2.1 Platform Purpose

GuestSelects is a visual aggregation and discovery platform that enables users to explore curated "digital rooms" or "showrooms" displaying home furnishings, décor, and related items. Users may interact with shoppable images by clicking on highlighted items ("Hotspots") to view product information and be redirected to third-party retailer websites.

2.2 Neutral Platform Status & Section 230 Notice

IMPORTANT NOTICE: GuestSelects constitutes an "interactive computer service" under 47 U.S.C. § 230. We do not create, edit, or endorse the content posted by third-party Room Designers.

GuestSelects is a neutral technology platform only. We do not:

Sell, manufacture, warehouse, ship, or fulfill any products
Set product prices or control inventory availability
Process payments or handle transactions
Employ, endorse, or control the third parties ("Content Creators," "Room Designers," or "Hosts") who curate showroom content
Own or control the affiliate links embedded within the Platform

The affiliate links displayed on our Platform are owned and managed by independent third-party Content Creators. All commissions, revenues, and payments derived from purchases made through these affiliate links are paid directly to the respective Content Creators-not to GuestSelects.

3. Third-Party Links, Products, and Services

3.1 External Websites

The Platform contains hyperlinks to third-party websites, including but not limited to retailer websites (Amazon, Etsy, Wayfair, and others). These links are provided solely for your convenience.

We do not control, endorse, or assume responsibility for:
The content, accuracy, legality, or availability of third-party websites
The privacy policies or practices of third-party websites
Any products, services, or transactions offered by third-party websites

3.2 Product Information Disclaimer

Product descriptions, images, prices, availability, and other information displayed on the Platform are provided by Content Creators or retrieved from third-party sources and are subject to change without notice.

You acknowledge that:

Product images may differ from actual products
Prices displayed may not reflect current retail prices
Product availability is determined solely by third-party retailers
All purchasing decisions are made at your own risk

4. Content Creator and Host Relationships

Content Creators, Room Designers, and Hosts who curate showrooms on the Platform are independent third parties-not employees, agents, or representatives of GuestSelects.

You acknowledge that Showrooms may contain affiliate links through which Content Creators earn commissions, but GuestSelects does not receive revenue from these affiliate transactions.

5. User Conduct

By using the Platform, you agree not to use it for any unlawful purpose, interfere with its security, use automated means (bots/scrapers) to access it, or copy/distribute its content without authorization.

6. User-Submitted Information

The Platform provides a "Request an Item" feature. When you submit a request, we may collect your email address under the legal bases of Legitimate Interest (to respond to you) and Consent.

This feature is powered by Tally (tally.so), and data is processed in accordance with their policy and GDPR standards. For full details on your rights (Access, Erasure, etc.), please see our Privacy Policy.

7. Analytics

We use PostHog with in-memory persistence (cookieless tracking). No cookies are stored on your device, and no data persists between sessions.

8. Intellectual Property

The Platform design and software are the property of GuestSelects. Product images and descriptions may be owned by third parties (Content Creators/Retailers) and are used under license or fair use principles.

9. DMCA Notice

GuestSelects respects intellectual property rights. If you believe content on the Platform infringes your copyright, please submit a DMCA notice to our designated agent at the contact email in Section 16.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THE ACCURACY OF CONTENT OR THE QUALITY OF PRODUCTS PURCHASED THROUGH THIRD-PARTY LINKS.

11. Limitation of Liability

To the maximum extent permitted by law, GuestSelects shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability to you for all claims shall not exceed the greater of $100.00 or the amount you paid to us in the last 12 months.

12. Indemnification

You agree to indemnify and hold harmless GuestSelects from any claims, damages, or expenses arising from your use of the Platform, your violation of these Terms, or your interaction with third-party Content Creators/Retailers.

13. Dispute Resolution

13.1 Binding Arbitration

Any dispute arising from these Terms shall be resolved by binding arbitration administered by the AAA.

13.2 Class Action Waiver

You and GuestSelects agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class action.

14. Governing Law and Jurisdiction

These Terms shall be governed by the laws of Romania. For claims not subject to arbitration, you agree to submit to the exclusive personal jurisdiction of the courts located in Bucharest, Romania.

Since we are based in the European Union, if you access the Platform from outside the EU (e.g., the US), you do so at your own initiative and are responsible for compliance with local laws.

15. General Provisions

These Terms constitute the entire agreement between you and GuestSelects. If any provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a right is not a waiver.
